A High Court sitting in Abuja has scheduled July 9, 2025, for the hearing of a lawsuit initiated by former Rivers State Federal lawmaker, Farah Dagogo, against President Bola Tinubu and others, regarding the declaration of emergency rule and the subsequent suspension of Governor Siminalayi Fubara, his Deputy, Professor Ngozi Nma Odu, and members of the Rivers State House of Assembly.
The presiding judge, Justice James Omotosho, adjourned the case following a request from the counsels representing the first and fifth defendants, Professor Kanyinsola Ajayi, SAN, and Abduljabar Aliyu, who sought additional time to adequately respond to the plaintiff’s submissions.
Naija News understands that a legal representative for the plaintiff, Babafemi Adegbite, did not contest the request.
The lawsuit, originally filed at the Port Harcourt Division of the Federal High Court, was moved to the Abuja Division following a directive from the Attorney-General of the Federation to the Chief Judge of the Federal High Court.
Dagogo is contesting the constitutionality of the President’s actions in Rivers State, particularly the appointment of an administrator in a state that has a democratically elected government.
He argues that the President does not possess the constitutional power to unilaterally suspend a democratically elected administration and replace it with an appointed administrator.
